If you do not agree to these Terms of Use or the Privacy Policy, you must not access or use the Website. This Website is offered and available to users 21 years of age or older. By using this Website, you represent and warrant that you meet the eligibility requirements. If you do not, you must not access or use the Website.

2. Changes to the Terms of Use. We may revise and update these Terms of Use from time to time at our discretion. All changes are effective immediately when posted, and apply to all access to and use of the Website thereafter. Your continued use of the Website following the posting of revised Terms of Use means that you accept and agree to the changes.

3. Accessing the Website and Account Security. We reserve the right to withdraw or amend this Website, and any service or material we provide on the Website, at our sole discretion without notice. We will not be liable if for any reason all or any part of the Website is unavailable. You are responsible for making all arrangements to have access to the Website and ensuring that all persons who access the Website through your internet connection comply with these Terms of Use. To access certain features, you may be asked to provide registration details or other information. It is a condition of your use that all information you provide is accurate and up to date. If you are provided with a user name, password, or any other security information, you must treat it as confidential.

4. Intellectual Property Rights. The Website and its entire contents (including, but not limited to, information, software, text, displays, images, and designs) are owned by the Company, its licensors, or other providers, and are protected by intellectual property laws. These Terms of Use permit you to use the Website for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, or exploit any content on the Website for commercial purposes without express written consent.

5. Trademarks. B Fancy Shop  and all related product and service names, designs, and slogans are registered or not registered trademarks or service mark of the Company or its licensors. You may not use such marks without prior written permission.

6. Prohibited Uses. You agree not to use the Website:

  • To engage in unauthorized advertising, including sending spam.

7. Product Information and Availability. We attempt to display product images and descriptions as accurately as possible, but cannot guarantee that product descriptions, colors, or images are error-free. All items are subject to availability, and we reserve the right to discontinue any product at any time.

8. Pricing and Payment.

(a) Prices: Prices are listed in  U.S dollars and may change without notice. However, changes will not affect orders that have already been placed.

(b) Payments: We accept major credit cards and PayPal, Google Pay, Apple Pay and Venmo. By submitting payment information, you authorize us to charge your payment method for the total amount of your order.

9. Shipping and Delivery. We offer various shipping options. Shipping charges will be calculated based on the method and delivery location. Delivery times are estimates and not guaranteed. You are responsible for any customs fees, duties, or taxes associated with international deliveries.

10. Returns and Refunds. At B. Fancy DBA, we are committed to providing high-quality jewelry and excellent customer service. Please review the following policies regarding returns, refunds, and store credits.

(a) Return Policy. We do not accept returns, and no refunds will be issued under any circumstances.

(b) Sale Items. If you receive a regularly priced item that is damaged or defective, you may be eligible to receive store credit. Refunds are not available. Please note that discounted or sale items, as well as shipping charges, are final sale and do not qualify for store credit. Any claims regarding damaged or defective items must be submitted within 48 hours of receipt of your order. Claims made after this period will not be considered. Additionally, only items that have been inspected by the customer upon receipt are eligible for store credit. To submit a claim, please send an email to hello.bfancyshop.com with your full name, order number, evidence of the damage or defect (photos or video), and a brief description of the issue to allow us to determine whether the item qualifies for store credit.

(c) Incorrect Item Selection. If you mistakenly select the wrong item, please contact us immediately so we can assist you in making the necessary changes. Modifications to your order can only be made prior to the order being packed. Once an order has been packed and a tracking number issued, no changes can be made. Store credit will only be provided for damaged or defective items as outlined in our policy. Unfortunately, we cannot issue store credit for items incorrectly selected by the customer, whether for reasons of size, color, or other product variations.

(d) Sizing Issues. We only offer store credit for items that are damaged or defective as specified in this policy. Unfortunately, we cannot issue store credit if an item does not fit as expected. To assist with your purchase, each product description provides measurements or size references. We recommend reviewing these details carefully before placing your order. If further information is needed, please contact us for additional sizing guidance.


(e) Store Credit. Once your request for store credit has been reviewed, we will notify you by email of the approval or rejection of your claim. If approved, the email will include instructions on how to redeem your store credit. Please note that store credit is limited to the cost of the item; shipping charges, discounted, or sale items are not eligible for credit.

(f) Delayed or Unreceived Store Credit. If you have not received your store credit, we recommend checking all folders in your email, including spam and promotions. If you are unable to locate the credit notification, please contact us at hello@bfancyshop.com for further assistance.

(g) Lost Packages. In the event that your package is lost in transit, we advise you to file a lost package claim with USPS. Occasionally, carriers may mark a package as delivered when it has not yet arrived. Typically, such packages are delivered on the next business day. If you require information to confirm package details, feel free to contact us. Please note that we cannot issue refunds or store credit for packages lost in transit, as this matter is beyond our control.

(h) Incorrect Shipping Address. If an incorrect shipping address is provided by the customer and the package is lost, it will not be eligible for a refund or store credit. In cases where the package is returned to us undamaged, the customer will be responsible for paying any additional shipping fees and providing the correct address for re-shipment. Alternatively, the customer may choose to receive store credit for the cost of the product only, excluding shipping fees. For all instances where packages are returned due to an incorrect address, the customer will be responsible for any associated shipping costs.

(i) Subscription Cancellation or Pause. After your initial subscription order, automatic payments will be processed on the 1st of each month. If the payment fails on the due date, the system will attempt to process the charge again on subsequent days. Once a payment has been successfully processed, refunds are not available. If you wish to pause or cancel your subscription, you must do so prior to the 1st of the next month by managing your account on bfancyshop.com or contacting us at hello@bfancyshop.com. Please note that once the subscription charge is processed, no refunds will be issued.

11. Limitation of Liability. We are not liable for any damages resulting from the use or inability to use the Website, or for any content, products, or services obtained through the Website. To the fullest extent permitted by law, we disclaim all warranties.

12. Indemnification. You agree to defend, indemnify, and hold the Company harmless from any claims, liabilities, damages, or expenses arising out of your use of the Website or violation of these Terms of Use.

13. Governing Law. These Terms of Use and any disputes arising from your use of the Website are governed by the laws of the Commonwealth of Puerto Rico. Any legal suit, action, or proceeding will be brought exclusively in the state or federal courts of Puerto Rico.

14. Entire Agreement. These Terms of Use, together with our Privacy Policy and Terms of Sale, constitute the entire agreement between you and the Company regarding the Website.
